This page describes the methods of managing the site with reference to the processing of personal data of users who consult it. This information is also provided pursuant to art.13 of Legislative Decree 196/2003 and EU Regulation 679/2016 to those who interact with the web services accessible electronically from the address: www.dmssrls.cloud

The Data Controller

Following consultation of this site, data relating to identified or identifiable persons may be processed. The "Controller" of their processing is Dms srls, represented by the legal representative pro tempore, with headquarters at Viale Aldini, 33 Bologna (BO)

Place of data processing

The processing related to the Web services on this site takes place at, at ARUBA BUSINESS srl, to be considered joint controllers of the processing, and is handled only by employees, collaborators, or persons in charge of the processing, or by any persons in charge of occasional maintenance operations. No data resulting from the Web service is communicated or disseminated. The personal data provided by users who submit requests for the sending of informational material are used solely for the purpose of carrying out the requested service or performance and are communicated to third parties only if this is necessary for that purpose (see chapter "optional provision of data").

Purpose of processing

The data collected is processed in compliance with the GDPR, in order to provide the service requested by the user and fulfill the obligation undertaken towards them, such as, for example, responding to information requests or requests to send the newsletter and related subscription to the mailing list, concerning informational messages and commercial and promotional communications related to the activities carried out by the Data Controller, in full compliance with the principles of lawfulness and fairness and legal provisions. However, depending on the requested service and the type of website, the data may be used for promotional activities or to enable contact with other customers. In any case, the data subject's consent will always be requested for each type of processing of their data.

TYPES OF DATA PROCESSED

Browsing Data

The computer systems and software procedures responsible for the operation of this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of the computers used by users who connect to the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the user's operating system and IT environment. These data are used solely to obtain anonymous statistical information on the use of the site and to check its correct functioning and are deleted immediately after processing. The data could be used to ascertain responsibility in the event of hypothetical computer crimes against the site.

Data voluntarily provided by the user

The optional, explicit, and voluntary sending of emails to the addresses indicated on this site entails the subsequent acquisition of the sender's address, which is necessary to respond to requests, as well as any other personal data included in the message.

Optional provision of data

Apart from what is specified for navigation data, the user is free to provide the personal data indicated in the request forms or otherwise indicated in contacts to request the sending of informational material or other communications. Failure to provide such data may make it impossible to obtain what has been requested. For completeness, it should be noted that in some cases (not related to the ordinary management of this site) the Authority may request information and data pursuant to art. 157 of Legislative Decree no. 196/2003, for the purpose of monitoring the processing of personal data. In these cases, a response is mandatory under penalty of administrative sanction. 'User name' and 'password': if you are required to choose a 'user name' and a 'password' to access reserved sections of the site, it will be your responsibility to keep such data confidential and to immediately notify us of their use by unauthorized persons.

Processing methods

Personal data is processed using automated tools for the time strictly necessary to achieve the purposes for which it was collected. Specific and adequate security measures are adopted to prevent data loss, unlawful or improper use, and unauthorized access in compliance with the obligations to implement minimum security measures. We inform you that, in order to provide a complete service, our portal contains links to other websites not managed by us. We are not responsible for errors, content, cookies, publication of unlawful moral content, advertising, banners, or files that do not comply with current regulatory provisions and for compliance with Privacy regulations by sites managed by us to which reference is made. Rights of data subjects

The subjects to whom the personal data refer have the right at any time to access their personal data to obtain confirmation of the existence or otherwise of such data and to know their content and origin, verify their accuracy, request their integration or updating, or correction (art. 15 and following EU Regulation 679/2016).

The data subject also has the right to object to the processing of data for legitimate reasons and, in particular, for those indicated in Art. 21 of the GDPR, to request the restriction of data as well as their portability. The data subject may request the deletion of their data if one of the reasons indicated in Art. 17 of EU Regulation 679/16 exists, which is reported in full below:

the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;

the data subject withdraws consent on which the processing is based in accordance with Article 6(1)(a) or Article 9(2)(a), and if there is no other legal basis for the processing;

the data subject objects to the processing pursuant to Article 21(1), and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2);

the personal data have been processed unlawfully;

personal data must be erased to comply with a legal obligation under Union law or the law of the Member State to which the data controller is subject;

the personal data was collected in relation to the offer of information society services referred to in Article 8, paragraph 1.

taking into account the available technology and the cost of implementation, adopts reasonable measures, including technical ones, to inform data controllers who are processing the personal data of the data subject's request to erase any links to, or copies or replications of, their personal data.

Paragraphs 1 and 2 do not apply to the extent that the processing is necessary:

for the exercise of the right to freedom of expression and information;

for the fulfillment of a legal obligation that requires the processing provided for by the law of the Union or of the Member State to which the data controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller;

for reasons of public interest in the field of public health in accordance with Article 9, paragraph 2, letters h) and i), and Article 9, paragraph 3;

for purposes of archiving in the public interest, scientific or historical research, or statistical purposes in accordance with Article 89, paragraph 1, to the extent that the right referred to in paragraph 1 is likely to render impossible or seriously impair the achievement of the objectives of such processing; or

for the establishment, exercise or defense of a right in legal proceedings.

The data subject may withdraw consent at any time if it has been given for one or more specific purposes, without affecting the lawfulness of processing based on consent given before the withdrawal.

The data subject, moreover, in the event of a breach of their personal data, may lodge a complaint with the competent supervisory authority.

Changes to this document

Dms srls reserves the right to update this Privacy Policy to comply with new laws, as well as taking into due consideration suggestions provided by employees, customers, collaborators, and users. In the event of changes to this Privacy Policy by Dms srls, the word 'update' will appear next to the Privacy Policy link on the main privacy page on the main page of www.dmssrls.it

In the event of substantial changes to the Privacy Policy, Dms srls will visibly publish such changes.
